Agreement
These terms of service govern your use of our golf event management platform. By accessing or using the platform, you agree to be bound by these terms. If you do not agree, please do not use the service.
Definitions
- Platform refers to the OpenGreen web application and related services.
- User refers to any individual who accesses or uses the platform.
- Event Organiser refers to a user who creates and manages golf events on the platform.
- Participant refers to a user who takes part in an event.
Account registration
To use certain features, you may need to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate and up-to-date information.
Use of the platform
You agree to use the platform lawfully and responsibly. You must not:
- Use the platform for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorised access to any part of the platform or its systems.
- Interfere with or disrupt the platform or the servers and networks connected to it.
- Submit false, misleading or inaccurate information, including scores or handicap data.
- Use automated tools to scrape, crawl or extract data from the platform without permission.
Event organisers
If you create and manage events on the platform, you accept additional responsibilities. You are responsible for the accuracy of event details, the fair administration of your events and compliance with any applicable rules or regulations. You acknowledge that participant data shared with you through the platform must be handled in accordance with data protection law.
Intellectual property
The platform, including its design, code, branding and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from any part of the platform without our prior written consent.
User content
You retain ownership of any data you submit to the platform, such as scores and event information. By submitting content, you grant us a licence to use, display and process that data as necessary to operate the platform and provide our services. This licence ends when you delete your content or close your account.
Availability and support
We aim to keep the platform available and reliable, but we do not guarantee uninterrupted access. The platform is provided on an "as is" and "as available" basis. We may carry out maintenance, updates or changes at any time, which may temporarily affect availability.
Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the platform. This includes, but is not limited to, loss of data, loss of profit or business interruption.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
Termination
You may stop using the platform and close your account at any time. We may suspend or terminate your access if you breach these terms or if we reasonably believe your use poses a risk to the platform or other users. On termination, your right to use the platform ceases immediately.
Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you through the platform. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.
